LightPulse Terms of Use

Acceptance

By downloading, installing, or using LightPulse (the "app"), you agree to these Terms of Use. If you do not agree, please do not use the app. LightPulse is provided by Robert Špan ("we", "us").

Wellness tool, not a medical device

LightPulse is a wellness tool, not a medical device. It is not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition. Heart-rate measurements are estimates for general wellness and informational purposes only.

Do not rely on LightPulse for any medical decision. Always seek the advice of a qualified healthcare professional with any questions about a medical condition, and never disregard or delay seeking professional advice because of something you read or measured in the app. If you think you may have a medical emergency, contact your local emergency services immediately.

Eligibility and acceptable use

You may use LightPulse only for lawful, personal, non-commercial purposes and in accordance with these terms. You agree not to reverse-engineer, tamper with, or attempt to disrupt the app, and not to use it in any way that could harm yourself or others.

LightPulse Plus subscriptions

LightPulse is free to use and lets you take up to three measurements each day. LightPulse Plus is an optional auto-renewing subscription that removes the daily limit and unlocks your full measurement history and the Insights screens.

• Plans and length. LightPulse Plus is offered as a more than one subscription length. The App Store and the purchase screen show the plans available to you and the length of each before you confirm. Every plan gives the same access for the whole of its period.
• Price. The price is shown in the App Store and in the app, in your local currency, before you confirm anything. Prices in each region are set from Apple's equivalent price tiers and may differ.
• Payment. Payment is charged to your Apple ID account when you confirm the purchase. LightPulse never receives or stores your payment details.
• Automatic renewal. The subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends, at the price of the plan you are on.
• Managing and cancelling. You can manage the subscription or turn off auto-renew at any time in Settings → your name → Subscriptions on your device. Cancelling stops the next renewal; the current period runs to its end.
• Price changes. If the price of your plan changes, Apple will notify you in advance, and where Apple requires it your subscription will not renew at the higher price unless you agree to it.
• Refunds. Purchases are handled by Apple, so refunds are requested from Apple rather than from us, through reportaproblem.apple.com.

If a subscription lapses or is cancelled, your measurements are not deleted. The free daily limit applies again, and your full history becomes visible once more if you resubscribe.

Your data

How LightPulse stores, encrypts, and processes your data is described in our Privacy Policy, which forms part of these terms. Your saved measurements stay in your own iCloud account, which we cannot access. Some technical and diagnostic data is collected separately — the Privacy Policy sets out exactly what.

No warranty

LightPulse is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to accuracy, fitness for a particular purpose, or uninterrupted operation. We do not warrant that measurements are accurate or that the app will be error-free.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any decision made or action taken in reliance on the app or its measurements. Nothing in these terms limits any liability that cannot be limited under applicable law, including your statutory consumer rights.

Changes to these terms

We may update these terms from time to time. The "Last updated" date above reflects the most recent change. Continued use of the app after an update means you accept the revised terms.
